Please read these Terms carefully before using SkoolCast. By creating an account or using any part of the platform, you agree to be bound by them, together with our Privacy Policy. If you are a parent or guardian registering on behalf of a learner under 18, you are accepting these Terms on that learner's behalf.

1 Introduction and acceptance

Skool Cast (Pty) Ltd trading as SkoolCast ("SkoolCast", "we", "us", "our") operates the website and learning platform at skoolcast.co.za (the "Platform"). By creating an account, accessing or using the Platform — whether as a student, parent/guardian, teacher, sponsor, or visitor (collectively "Users") — you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any additional guidelines we publish. If you do not agree, please do not use the Platform.

These Terms are governed by the laws of the Republic of South Africa, including (where applicable) the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Consumer Protection Act 68 of 2008 ("CPA"), the Protection of Personal Information Act 4 of 2013 ("POPIA"), the Copyright Act 98 of 1978, the Children's Act 38 of 2005, and the Cybercrimes Act 19 of 2020.

We may suspend or terminate accounts, remove content, and/or report conduct to the relevant authorities (including the South African Police Service or SACE, where appropriate) where we reasonably believe these Terms or the law has been breached.

7 Content, copyright and intellectual property

7.1 Ownership of platform IP. The SkoolCast name, logo, software, design, user interface and underlying technology are owned by or licensed to SkoolCast and are protected under the Copyright Act 98 of 1978, trade mark law, and other applicable intellectual property laws. You may not copy, reproduce, modify, reverse-engineer or create derivative works from any part of the Platform without our prior written permission.

7.2 Teacher and user-uploaded content. When a teacher or other user uploads or publishes content (e.g. lessons, videos, audio, PDFs, quizzes, marketplace listings, messages, or comments) ("User Content"), that user:

7.3 We do not claim ownership of User Content. Removing your account does not automatically remove previously published content where students have already lawfully unlocked or paid for access, but we will deactivate further public access where reasonably possible.

7.4 We respect copyright and expect our users to do the same. We will not knowingly publish or permit the publication of material that infringes another person's copyright — state only what you have the rights to publish; never upload work that you do not own or are not licensed to use.

7.5 Reporting copyright infringement (takedown requests). If you believe that content on the Platform infringes your copyright or other intellectual property rights, please send a written notice to our designated contact (see "Contact us" below) including:

  1. identification of the copyrighted work claimed to be infringed;
  2. identification of the material you allege is infringing and its location on the Platform;
  3. your contact details;
  4. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law; and
  5. a signed declaration that the information in the notice is accurate and that you are the owner, or are authorised to act on behalf of the owner, of the right claimed to be infringed.

On receipt of a valid notice, we will investigate and may remove or disable access to the disputed material, notify the user who posted it, and — for repeat infringement — suspend or terminate the relevant account.

8 AI-assisted features

Some features (such as AI Homework Help) use third-party artificial intelligence services to generate explanations, summaries, or suggested answers. AI-generated content is provided for study-support purposes only, may contain errors or inaccuracies, and should not be treated as a substitute for guidance from a qualified teacher or for officially endorsed DBE/CAPS material. Always verify important information independently, particularly before examinations or assessments.

9 Disclaimers and limitation of liability

9.1 The Platform, its content and all related services are provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties — express or implied — regarding the accuracy, completeness, reliability, availability or fitness for a particular purpose of the Platform, its content, or any results (including academic results, marks, or examination outcomes) that may be obtained from using it.

9.2 Although SkoolCast is built using current cloud-storage, streaming and security technologies, no online platform can guarantee complete security or uninterrupted operation. We do not promise that the Platform will be free from bugs, vulnerabilities, viruses, downtime or data loss, and — except where such liability cannot lawfully be excluded (including under the Consumer Protection Act 68 of 2008) — we are not liable for any harm arising from such occurrences.

9.3 To the maximum extent permitted by law, SkoolCast, its directors, employees, contractors and partners will not be liable for any indirect, incidental, special, consequential or punitive loss or damage (including loss of data, loss of income, or loss arising from reliance on AI-generated or user-generated content) arising from or related to your use of, or inability to use, the Platform.

9.4 Nothing in these Terms limits any right or remedy that cannot lawfully be excluded or limited, including any non-excludable rights you may have as a consumer under the CPA.

10 Privacy and data protection

Our collection, use, storage and sharing of personal information is described in our Privacy Policy, which forms part of these Terms and is aligned to the Protection of Personal Information Act 4 of 2013 (POPIA). We are committed to transparency: we do not sell personal information, and we do not expose user data beyond what is necessary to operate the Platform, comply with the law, or as you have consented to.

11 Suspension and termination

We may suspend or terminate any account, with or without notice, where we reasonably believe these Terms have been breached, where required by law, or to protect the safety, rights or property of SkoolCast, its users, or third parties. You may close your account at any time by contacting us; certain information may be retained where the law requires it (see our Privacy Policy for retention details).

12 Changes to these Terms

We may update these Terms from time to time to reflect changes in the law, our services, or our business. Where changes are material, we will give reasonable notice (for example, via the Platform or by email) before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

13 Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform will, where possible, first be referred to good-faith negotiation between the parties, and thereafter to the courts of South Africa having jurisdiction — without prejudice to any right you may have to refer a consumer complaint to the National Consumer Commission or other applicable regulator.
